Surveillance video shows the Coral Springs man was racing a motorcycle in his BMW prior to the crash that killed an 80-year-old driver.
On Sunday, Maxx Bernstein, 29, was arrested after surrendering himself at the Broward Sheriff’s Office main jail. Investigators determined that the fatal crash on August 18 happened when James F. Stewart was headed west on Northeast 14th Street in Pompano Beach and attempted to turn south onto Northeast 27th Terrace. His Lexus was struck by Bernstein’s BMW, which was headed east in the right lane. On impact, both sedans left the road and knocked a concrete utility pole from its base.
Pompano Beach Fire Rescue responded to the scene and pronounced Stewart dead. Bernstein was taken to Broward Health North where he was treated and released. Florida Power and Light also came to the crash site to secure the utility lines.
Based on witness accounts and surveillance video, it appeared that Bernstein was racing a motorcycle prior to the crash. Detectives said his BMW was going about 95 mph in a 35 mph zone.
He faces a number of charges including one count of vehicular homicide and four counts of reckless driving. He also has been ordered to surrender his passport.
